Application for Shellfish Aquaculture Lease - Marsh

Chincoteague Bay

The Secretary of Maryland Department of Natural Resources (DNR), pursuant to Natural Resources Article, 4-11A-09(g), Annotated Code of Maryland, is giving notice of applications for three shellfish aquaculture water column leases by Donald Marsh in Chincoteague Bay, Worcester County, Maryland. The proposed sites are located off South Point and west of the marked Federal channel.

The first and westernmost proposed area, contains 5.3 acres, more or less, and is enclosed by a line beginning at corner 1, at or near Lat. 38 12' 30.4" N., Long. 75 12' 15.5" W., then running 316 48' (True), approximately 161 meters to corner 2, at or near Lat. 38 12' 34.2" N., Long. 75 12' 20.1" W., then running 45 32' (True), approximately 138 meters to corner 3, at or near Lat. 38 12' 37.3" N., Long. 75 12' 16.1" W., then running 138 5' (True), approximately 155 meters to corner 4, at or near Lat. 38 12' 33.6" N., Long. 75 12' 11.9" W., then running 222 45' (True), approximately 132 meters to the point of beginning.

The second proposed area, located approximately 840 ft south and east of the first, contains 3.2 acres more or less and is enclosed by a line beginning at corner 1, at or near Lat. 38 12' 21.8" N., Long. 75 12' 2.3" W., then running 316 25' (True), approximately 159 meters to corner 2, at or near Lat. 38 12' 25.6" N., Long. 75 12' 6.8" W., then running 44 41' (True), approximately 82 meters to corner 3, at or near Lat. 38 12' 27.5" N., Long. 75 12' 4.5" W., then running 137 36' (True), approximately 159 meters to corner 4, at or near Lat. 38 12' 23.8" N., Long. 75 11' 59.9" W., then running 224 40' (True), approximately 82 meters to the point of beginning.

The third proposed area, located approximately 1085 ft south and east of the second, contains 10.2 acres more or less and is enclosed by a line beginning at corner 1, at or near Lat. 38 12' 9.4" N., Long. 75 11' 49.6" W., then running 318 16' (True), approximately 159 meters to corner 2, at or near Lat. 38 12' 13.2" N., Long. 75 11' 53.9" W., then running 45 36' (True), approximately 264 meters to corner 3, at or near Lat. 38 12' 19.3" N., Long. 75 11' 46.3" W., then running 138 57' (True), approximately 154 meters to corner 4, at or near Lat. 38 12' 15.6" N., Long. 75 11' 42.1" W., then running 224 37' (True), approximately 265 meters to the point of beginning.

The applicant proposes to place cages on bottom up to a maximum of 12 high for the purpose of culturing Eastern Oyster (Crassostrea virginica), and to harvest using methods approved by the Department. A map of the proposed lease is available below.

A series of well-attended public hearings and informational meetings regarding these leases were held in Worcester County. No additional public informational meetings will be held. Any person who has a specific right, duty, privilege, or interest that is different from that held by the general public and may be adversely affected by one or more of the proposed leases may request a contested case hearing by filing a Petition of Protest with the Department. Petitions for an administrative hearing must include the name and contact information of the protestant, the right of the protestant that would be adversely affected by the proposed lease(s), and the grounds for opposing issuance of the lease. Petitions that meet the requirements of Natural Resources Article 4-11A-09(g) shall be forwarded to the Office of Administrative Hearings for adjudication. Petitions of Protest must be received by the Department of Natural Resources Aquaculture Division 580 Taylor Avenue C-2 Annapolis, MD 21401 by September 17, 2012.
